Probate & Trust Administration

Navigating Probate & Trust Administration with Confidence

The death of a loved one often brings legal and financial responsibilities at a time when families are already navigating significant change. Determining what must be done, what to prioritize, what deadlines apply, who has authority to act, and how assets should be handled can quickly become overwhelming.

AC Law Firm provides guidance throughout probate and trust administration. We work with Personal Representatives and Trustees to understand their responsibilities, navigate the administration process, and address the legal issues that may arise along the way.

Our goal is to bring clarity and structure to the process while helping fiduciaries fulfill their responsibilities and move the administration toward an appropriate resolution in a timely manner.

Probate & Estate Administration

Probate is the court-supervised process through which a deceased person's estate may be administered. Depending on the circumstances, the process can involve identifying and valuing assets, addressing creditor claims, resolving outstanding obligations, preparing required filings and accountings, and ultimately distributing estate property to the appropriate beneficiaries or heirs.

AC Law Firm assists clients throughout the estate administration process, including:

  • Determining whether probate is necessary
  • Opening an estate
  • Petitioning for the appointment of a Personal Representative
  • Advising Personal Representatives regarding their fiduciary responsibilities
  • Identifying, collecting, and valuing estate assets
  • Preparing inventories and required probate filings
  • Addressing creditor claims and estate obligations
  • Coordinating appraisals and asset valuations
  • Assisting with the sale or transfer of estate property
  • Preparing fiduciary accountings
  • Communicating with beneficiaries and interested persons as requested
  • Addressing disputes or complications that arise during administration
  • Distributing estate assets
  • Closing the estate

Representing Personal Representatives

Being named as a Personal Representative can carry significant responsibility.

A Personal Representative may be responsible for safeguarding estate property, identifying assets and debts, complying with court requirements, maintaining appropriate records, communicating with interested persons, resolving valid claims, and ensuring that distributions are made properly.

For many Personal Representatives, this is the first time they have been responsible for administering an estate.

AC Law Firm works closely with Personal Representatives throughout the process, helping them understand what is required, anticipate upcoming responsibilities, maintain appropriate documentation, and make informed decisions as issues arise.

Trust Administration

A trustee's responsibilities often become more substantial after the death or incapacity of the person who created the trust. Even when trust assets do not pass through probate, administering a trust can involve significant legal, financial, and fiduciary obligations.

AC Law Firm assists trustees with understanding the governing trust documents and carrying out their responsibilities during administration.

Trust administration services may include:

  • Reviewing and interpreting trust documents
  • Advising successor trustees regarding their duties
  • Identifying and securing trust assets
  • Coordinating asset valuations
  • Reviewing ownership and beneficiary information
  • Assisting with required notices and communications
  • Addressing outstanding liabilities and expenses
  • Coordinating with accountants, financial institutions, and other professionals
  • Preparing or reviewing fiduciary accountings
  • Advising regarding distributions to beneficiaries
  • Addressing beneficiary questions and disputes
  • Assisting with the transfer or retitling of trust property
  • Guiding trustees through the completion of trust administration

Fiduciary Guidance & Accountings

Personal Representatives and trustees are fiduciaries. That role carries important responsibilities concerning the management, preservation, documentation, and distribution of assets belonging to an estate or trust.

Good recordkeeping is an essential part of that responsibility.

AC Law Firm assists fiduciaries with organizing and documenting financial activity, understanding accounting obligations, and preparing or reviewing fiduciary accountings when required.

When an estate or trust involves investment accounts, real property, business interests, significant transactions, or other complex assets, careful documentation can be particularly important.

When Probate and Trust Administration Overlap

An individual's estate plan may include both probate and non-probate assets. For example, some property may be owned by a trust while other assets remain individually titled and require probate administration.

When both an estate and trust must be administered, the Personal Representative and trustee may have separate—but sometimes overlapping—responsibilities.

AC Law Firm can help identify which assets belong to the estate, which are governed by a trust or beneficiary designation, and what administrative steps may be necessary for each.

Frequently Asked Questions

Do all estates have to go through probate?

No. Whether probate is necessary depends on how the deceased person's assets were owned, the value and nature of those assets, beneficiary designations, and other circumstances. Some assets may transfer outside of probate even when a probate estate must be opened for other property.

What does a Personal Representative do?

A Personal Representative is responsible for administering the probate estate. Responsibilities may include locating and protecting assets, addressing debts and creditor claims, complying with court requirements, maintaining financial records, communicating with interested persons, and distributing estate property.

Does having a trust mean there is no administration after death?

No. A trust may allow properly titled assets to avoid probate, but the trust itself generally still requires administration. The successor trustee may need to identify assets, address expenses and liabilities, communicate with beneficiaries, maintain records, and ultimately distribute or continue managing trust property according to the trust's terms.

How long does estate or trust administration take?

There is no single timeline. The length of administration can depend on the nature and value of the assets, creditor issues, tax matters, property sales, beneficiary disputes, court requirements, and other circumstances. More complex estates and trusts may require substantially more time to administer properly.

What if beneficiaries and the Personal Representative or Trustee disagree?

Disagreements can arise regarding distributions, property, accountings, communications, fiduciary decisions, or the interpretation of estate planning documents. Addressing concerns early may help prevent disagreements from developing into more significant disputes. When necessary, legal counsel can assist with determining the fiduciary's obligations and available options.

Clear Guidance From Administration to Distribution

Probate and trust administration can involve much more than completing forms. Fiduciaries are often required to make important decisions while balancing legal obligations, financial considerations, deadlines, and family dynamics.

AC Law Firm provides practical legal guidance throughout the administration process so that Personal Representatives and trustees understand their responsibilities, the decisions before them, and the steps necessary to move the matter forward.

Whether you are preparing to open an estate, have already been appointed as Personal Representative, are beginning your responsibilities as successor trustee, or have encountered complications during administration, we can help you determine the appropriate next steps.
